    ARTICULO 606.-Adopción por tutor. El tutor sólo puede adoptar a su pupilo una vez extinguidas las obligaciones emergentes de la tutela.



    I. RELACIÓN CON EL CÓDIGO CIVIL. FUENTES DEL NUEVO TEXTO

    Su antecedente es el art. 319 del Código reformado. Una norma similar se encontraba en todas las leyes sobre adopción de nuestro paí­s.



    II. COMENTARIO

    El tutor sólo puede adoptar a su pupilo en tanto se encuentre extinguida la tutela, es decir que se hayan rendido y aprobado las cuentas y se hubieren pagado los saldos. La prohibición, al igual que el impedimento matrimonial, se basa en la posibilidad de que el tutor intente incumplir sus obligaciones legales mediante el instituto.
